Dear Sir,
First time after Modi become Chief Minister Governor of Gujarat has invoked special powers and appointed a lokayuta in Gujarat without waiting for a recommendation from State Government of Modi. That is one of the bold step taken by the Governor, which is guaranteed by the constitution of India.
In fact, Modi and his cabinet are involved in every type of unconstitutional activities. Now Modi cries and tried to project the constitutional act as unconstitutional. Modi Government spokesperson Jaynarayan Vyas said the act is not in the spirit of the constitution. Jaynarayan contention is foolish. Gujarat Government can act unconstitutionally, but if Governor used their powers, Gujarat Government is looking worried. Governor of Gujarat have exercised her constitutional powers according to Gujarat Lokayukta Act, 1986 Clause 3(1) that clearly stated, “For the purpose of conducting investigations in accordance with the provisions of this Act, the Governor shall, by warrant under his hand and seal, appoint a person to be known as Lokayukta”.
Under the Act, the Governor was the “appointing authority” and he or she should consult the Chief Justice of the High Court and the leader of the Opposition of the Assembly. There is no question of bypassed the entire government as expressed by Vyas.
Now time has come to act by the central Government of UPA and Impose President's rule in the State of Gujarat Under Article 356 of the Constitution of India. As demanded in my letter No. ZAK/CJI/P/PM/HM/LM/MT/E/60 of dated 12/08/2011.
