Dear Sir,
Rape is a criminal act
according to the legal terminology and religiously. Almost every religion disapproves the sexual
intercourse on women without the religious rites and customs are being
followed. If an act of sexual
intercourse has been carry out on a lady without her consent it is RAPE and in
India it is punishable offence according to Indian Penal Code and the maximum
punishment is seven years to life term.
In some cases death punishment has also been awarded which is executed
on the criminal.
Still men are committing rape
on women, which is common crime on ladies after family harassment. Undersigned surveyed and discussed near about
1000 women at least 95% told that they are being sexually harassed in any form;
including; touching inappropriately, while speaking with them, slapping to them
on her thighs, shoulders or hand, watching towards them with malicious dirty
intention. A common practice in public transport, standing
behind a lady and touching inappropriately to her, which amounts to molestation.
In the survey at about 85% women told
they are being harassed and faced mental agony while travelling to the public
transport. However, office going or
daily shuttling women are used to with such practice so they never retaliate,
or such types of cases never come to the public though such types of cases are
also common. Most of the office ladies are
in hurry for catching public transport and wanted to reach office as early as
possible or at least on time so they did not care to such types of things.
Delhi may be the number one as
far as sexual harassment on ladies is concerned. Delhi had seen a gang rape on 16 December
2012 of a 23 years old Physiotherapy student who succumbed to her injuries.
Navi Pillay chief of UN Human
Rights blame India, for heinous crimes because of lack of strengthen laws. Law will not serve the purpose if devil
captured the mind and soul of the particular he can commit any crime which
defames the humanity.
Social Networking Media and environment played big role for increasing the number of sexual harassment cases
on ladies. Nowadays social media and
networking is very common. Every seven members out of ten are using internet. I am using the website of India Times News Paper;
on the opening of the page some pornographic contents are displayed. Article related to sex, photos showing man
and woman involve in sex. Such types of
contents and articles certainly affect the mentality of the youths.
Sex is the natural process as
we require meal when we hungry in the same way we require the partner to relax
the sexual desire. But when it is
committed after mutually agreeable terms by both the partners after marriage is
legally correct and if it is committed without consent by either of the partner
is illegal and punishable offense. Now question
arises can a woman rape a man?” my
answer is no never because Rape is unwilling act of sexual intercourse
committed penis in vagina and it is specifically mentioned in dictionaries that
rape is ‘any act of sexual intercourse that is forced upon a person’. Currently
penetration is a necessary ingredient to charge a person with rape offence and
most people believe it is not possible by a woman to commit this crime because
of biological reasons. In Indian Penal
Code too nowhere is mentioned the punishment of rape by a lady and no
punishment has been define in the legal term.
So far no court has been convicted a lady for committing rape on male.
The new offence of rape in
section 1(1) SOA 2003 includes oral and anal penetration with a penis. This is
a change from the previous law which was only concerned with vaginal
penetration and used other offences to criminalise these forms of sexual
violence. The person who commits the offence of rape must be a man as the
penetration has to be with a penis
Some sort dress also played the
big role in committing such types of crimes on ladies. Almost every big cities women used to put on semi
nude dresses which attracts the opposite sex towards them and they start
committing crimes even on the woman who dressed salwar kameez.
In India sexual assault is very
common on ladies, harsh punishment is the solution, but one more thing is require,
the other inmates of the rapist should be socially boycott and debarred from
the society, they are not allowed to marry, purchasing and attended the social
events.
Thanking you,
